Expected delivery dates are subject to change and you will be notified should any unexpected delays occur.

Any in stock items purchased in the same order as a pre-order item will be dispatched on the specified pre-order dispatch date. If you would like to receive your in stock item prior to the pre-order dispatch date please place a seperate order for it.

CANCELLATION OF PRE-ORDERS

You may cancel your pre-order as long as the item has not been shipped. If the pre-order is in transit, returns are based on our standard return policy. To enquire about the possibility of cancellation of a pre-order please contact us by writing to info@formandfold.com

When pre-order item arrives in stock you will be notified via email. Your item will be shipped according to our standard shipping policy, and usually within 3 working days.

RETURN OF PRE-ORDERS

Our standard return policies apply to all pre-orders.

Orders

You warrant that all information provided to us in respect of your order is correct.

Returns

Form and Fold reserves the right to refuse a return if the return conditions are not met.

Exchanges

Exchanges are subject to availability. If your exchange request is unavailable and alternative arrangements have not been made within 7 days of receiving your return then the returned item(s) will automatically be refunded.

Delivery

Any stated date for delivery is an estimate only. We will use our reasonable endeavours to meet any estimated delivery dates but will not be liable for any loss suffered by you or any third party as a result of any delay.

Gift Cards/Credit Notes

Valid for 12 months from the issue date, unless issued after 30 November 2019 in which case it is valid for 3 years. Gift cards are non-refundable.

Cancellation by Form & Fold

We reserve the right to cancel an order if a Product is not available for any reason. If we cancel an order, we will contact you and return any payment you have made. Refunds will be made by the same payment method used by you when placing your order.

Cancellation by you

Unless we otherwise agree, no cancellation of an order or any part of it is binding on us once we have accepted your order. If you wish to enquire about the possibility of cancellation your order, please contact us by writing to info@formandfold.com

Pricing

Unless otherwise stated, the prices for Products listed on this website exclude delivery, GST and any other taxes or duties in relation to the Products. The total price payable by you (including GST and delivery) is the amount specified at the end of the order process.

Product Description & Sizes

All photographs, size indications and descriptions of Products on this website are for guidance only. Slight variations in colour may occur.

Passing of Property

Until we receive full payment in cleared funds for all Products, title and property in the Products remain vested in us.

Risk and Insurance

The risk in the Products and all insurance responsibility for theft, damage or otherwise will pass to you immediately on delivery.

Warranty and Liability

Except as otherwise provided by law, our maximum liability to you is the refund of the price of the Products or the replacement of the Products, at our sole discretion. Unless otherwise required by law we will not be liable for any indirect or consequential losses suffered by you or any third party.

Nothing in these Terms restricts, limits or modifies your rights or remedies against us for failure of a statutory guarantee under the ACL, or is to be interpreted as excluding, restricting or modifying or having the effect of excluding, restricting or modifying the application of any State or Federal legislation applicable to the sale of goods and services which cannot be excluded, restricted or modified.

Force Majeure

We are not liable in any way however arising under these Terms, to the extent that we are prevented from acting by events beyond our reasonable control.

Governing Law

The law of Victoria from time to time governs these Terms. The parties agree to the non-exclusive jurisdiction of the courts of Victoria, the Federal Court of Australia, and of courts entitled to hear appeals from those Courts.

Severance

If a provision of these Terms are invalid or unenforceable it is to be read down or severed to the extent necessary without affecting the validity or enforceability of the remaining provisions.

No Wavier

Our failure to enforce any of these Terms shall not be construed as a waiver of any of our rights.

Definitions

In these Terms:

• ACL means the Australian Consumer Law Schedule to the Competition and Consumer Act 2010 (Cth).

• GST has the meaning given in A New Tax System (Products Tax) Act 1999 (Cth) as amended.Products means any products which we make available to you.

• Terms means these Terms and Conditions of Sale and include any other terms and conditions made available on our website from time to time.

The Form and Fold mobile message service (the "Service") is operated by Form and Fold (“Form and Fold”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Form and Fold’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Form and Fold through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Form and Fold. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to FormandFold or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Form and Fold mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
